I'm sure someone from the legal side of things has though this through, but how does one determine if someone crawling a website is "harvesting" data.
For example I'm sure the law does not exclude companies like Google who capture data, but do not act on it?
What I'm wondering is if its "illegal" to harvest email addresses and not actually use them? I.e. if someone just decided for some reason to gather email addresses into a list but does not act on them? Is it is practical to police this, how do you detect and enforce this?
I've working in law enforcement before and there's a fine line between making it illegal to do something and actually being able to prosecute.
